Analysing India’s Unique Subnational WHO FCTC Article 5.3 Policies and Their Implementation Across 17 States and Union Territories

The report presents findings from a multi-state assessment of subnational implementation of Article 5.3 policies designed to protect against tobacco industry interference.

Assessing 17 States and Union Territories that had adopted Article 5.3 policies by 2023, the study aimed to:  

  • Measure stakeholder awareness of Article 5.3 policies, including their existence, scope, and provisions
  • Identify barriers and challenges to policy adoption and implementation 
  • Document practices that facilitate effective state-level implementation 
  • Develop recommendations to strengthen policy implementation across states

Drawing on India’s experience as the world’s second-largest producer and consumer of tobacco, it provides practical lessons and recommendations on how subnational governments can strengthen protections against tobacco industry interference. 

Subnational Article 5.3 policies hold significant potential to reduce tobacco industry interference. However, their effectiveness can be enhanced through clearer implementation guidance, stronger oversight mechanisms, greater awareness among non-health departments, institutionalized complaint systems, and regular monitoring of tobacco industry interference at the subnational level.
